完善西部地区环境立法的思考

反思西部地区环境立法中存在的主要问题。针对一些原有的法律观念、法律原则,提出要以一种全新的适合保护全球生态环境需要的角度来重新加以探讨和运用。指出环境立法思想应以生态规律为全面指导,树立环境资源价值观,强调环境承载能力有限的规律等,认为西部民族地区环境立法的重点和应对策略应是科学制定地方环境立法规划,利用地方自治优势,加快地方环境资源立法速度,完善地方立法体系和法律约束机制,在立法中突出以防为主的法律原则,建议赋予乡一级政府组织环境保护职能等。

Perfect Environmental Legislation in the West of China

According to the existing old ideas and principles of law,the paper points out a new point of view to fit for global environmental protection.It holds that the ideas of environmental legislation should abide by ecological law and stress the threshold of environmental carrying capacity.And the focus of environmental legislation in western areas is to make a local scientific environmental legislation planning,speed up local legislation with its autonomous advantage.It also suggests that governments at the town level should be endowed with the function of environmental protection.
