农地确权内涵体系的逻辑结构及其三维检视

研究目的:研究农地确权内涵体系的逻辑结构,并将该逻辑结构含有的三个逻辑层次转换为三个研究维度,展开延伸并检视。研究方法:系统研究法、结构分析法、实证研究法。研究结果:农地确权内涵体系的逻辑结构至少有三个逻辑层次,即产权性质确认、产权框架或三权分置式确认、产权核心或农户承包权确认。农地确权清晰化的进路,本质上是农地确权理念的共识达成和农地确权关系的均衡达成。研究结论:农地确权应做到"三协同、一转化",即协同推进农地产权功能治理市场化,协同推进农地"三权分置"可操作化,协同推进农地确权的技术标准、测量规范和数据管理科学化,以及促进承包地的实物调整向权益调整转化。

The Logical Structure and Three-dimensional View of the Connotation System of Farmland Property Right Registration

The purpose of the paper is to study the logical structure of the connotation system of farmland property right registration,to transform the three logical levels contained in this logical structure into three research dimensions and to make the corresponding investigation.The research methods employed include systematic research,structural analysis and empirical research.The results show that there are at least three logical levels in the logical structure of the connotation system of farmland property right registration,that is,the recognition of property right nature,the framework of property right or the identification of three rights,the core of property rights or the confirmation of farmers' contractual rights.The approach to the clarity of the rights of farmland is in essence,the consensus on the concept of farmland property right registration and the balance of the relationship among the rights of farmland.In conclusion",Three synergy, One transformation" should be enforced,that is,the coordinated promotion of farmland property right function governance marketization as well as the synergic implementation of tripartite entitlement system of farmland,the coordination of technical standards,measurement standards and data management regarding farmland property right registration as well as the transformation of contractual rights to farmland from the physical adjustment to the interest adjustment.
