刑法司法解释溯及力问题探微

刑法司法解释的溯及力，应当一律按照新的司法解释，还是按照从旧兼从轻原则，这是司法实践中的难题。现有的规定对这一问题的立场本身也是矛盾的。司法解释的性质所呈现的理想与现实的错位，造成了刑法司法解释溯及力问题的困境。从应然与实然两个层面解决这种困境是较好的方案。一方面应当规范司法解释的内容，另一方面，当刑法司法解释属于刑法条文可能含义之内时，应当直接适用司法解释，而当其突破刑法条文可能含义时，为了维护罪刑法定原则，则应当遵循从旧兼从轻原则。

As for the retroactivity of criminal judicial interpretation,one viewpoint is to directly apply the new published judicial interpretation,another opposite viewpoint is to apply the principle of applying former and lighter.The stand of existed rules is paradoxical itself.The character of judicial interpretation,which is inconsistent in reality and ideality,led to the dilemma of the retroactivity of criminal judicial interpretation.It is a relative good solution to deal with this situation from reality and ideality.In one hand,it is necessary to regulate the content of judicial interpretation.In the other hand,the judicial interpretation should be applied directly when the content of j udicial interpretation is in the scope of possible meaning of the criminal law.When the content of judicial interpretation is not in the scope of possible meaning of the criminal law,in order to maintain the principle of legality,it is necessary to apply the principle of applying former and lighter.
