中国传统法观念与现代法治精神之悖离探析

现代法治精神是建设社会主义法治国家的思想保证和精神动力。它的形成离不开特定文化的催化和诱导。而我国传统的法观念与现代法治精神存在诸多悖离：传统的君权至上的人治观与法律至上观念相悖离；传统的权力本位意识与现代权利核心观念相悖离；传统的伦理取向与现代法律价值相悖离；传统的等级特权意识与现代平等观念相悖离；传统的畏法厌讼、惧法耻讼意识与现代法治的诉讼观念相悖离。因而，扬弃传统法观念，弘扬现代法治精神是建设社会主义法治国家的内在的、迫切的要求。
