法治中国视野下检察机关内部组织关系改革--从内部决策机制与“人-组织”关系角度出发

改革和完善检察机关的内部组织体系，实质上即是改革和完善检察机关的组织机构和组织结构，主要目的在于形成一个高效统一的工作系统来保证检察权的有效行使和顺畅运作。从检察机关内部组织关系的角度考察，这一改革涉及检察机关内部决策机制和检察长与检察官关系定位等两个主要问题。在改革检察机关内部决策机制方面，检察机关以检察长和检察委员会为主要组织载体，采取集体--个人相结合、检察长个人负责制与民主集中制相结合的决策机制，因此需要对检察长和检察委员会的权责划分作进一步的厘清。在完善检察长-检察官关系方面，检察长的职权定位应当坚持司法权能与行政权能的统一，检察官的职权定位应当坚持权责一致原则，检察长与检察官的职权界分应当坚持检察一体化与自由裁量的统一。

On the Reform of Procuratorial Organs Internals' Relationship under the Perspective of Rule China by Law---From the Perspective of the Inner Decisive Mechanism and the "People - Organization"Relationship

The Reform and Improvement of Procuratorial Organs Internals' Relationship, in essence is to reform and im-prove the organizations and organizational structure of procuratorial organs. The main purpose is to encourage the procuratorial organs internal system to be efficient and powerful systemized to ensure the effective execution and efficient operation of pros-ecutorial power. From the Angle of the procuratorial organs internals' relationship, it mainly involves two questions: the procu-ratorial organs' inner decisive mechanism; the connection orientation between attorney general and prosecutor. In the reform of procuratorial organs internal decision-making mechanism, the attorney general and the procuratorial committee as the main or-ganization carrier of procuratorial organs should take the collective-individual, attorney general personal responsibility system with the combination of democratic centralism as decision-making mechanism. Therefore, we need to further clarify the power between the attorney general and the procuratorial committee. On the problem of the relationship between attorney general and prosecutor, it is necessary to define that the functions and powers of attorney general's position shall adhere to the unity of the judicial power and administrative power, the functions and powers of prosecutor should adhere to the principle of power and responsibility consistent, the boundary points of authority between the attorney general and prosecutor should adhere to u-nification between integrated public prosecution and discretion.
