论可持续发展与人类环境权

“可持续发展”理论赋予发展以新的内涵，并拓展了传统的法律价值领域。对人类环境权的法律保护，是环境法中“可持续发展”理论的具体体现。人类环境权的主体是包括未来人在内的全人类，对野生动植物的保护是将其作为形式主体。人类环境权具有人身权、代际权、共享权的特点，并受经济与自然条件、国际政治环境的制约。

Sustainable Development and the Environmental Rights

The concept of sustainable development has expanded the connotation of the term, development, and contributed high value to the traditional law. The objective of applying this concept in the law of environment protection is to protect the human environmental rights .The subject of the Human Environmental Rights is thus the mankind both at present and in the future. The wildlife is regarded as the formal subject rather than the subject in the law legislated for protection of the wildlife. As one of its major characteristics the Human Environmental Rights includes the personal rights, the intergenerational rights and the common rights.It is therefore subject to natural and economic conditions of the country and further to relevant international political restrictions.
