农地产权制度的缺陷与规制设计

我国农地产权不完善,土地所有权虚化,使用权受干涉,收益权受侵蚀,处置权残缺,导致农民经营权程度不同受到各级行政侵犯,制约了土地资源优化配置。构建从法律上明确土地所有权主体和完善其它权能的农地产权制度,推进农地产权制度创新,使农户在法律上拥有财产权上的排他性、使用权专有性、收益权上的独享性、流转权上自主性,促进产权功效发挥,实现资源配置优化。

Rural land equity mechanism's shortage and regulation design

Due to that the rural land property is imperfect,land ownership virtual,use rights interfered,usufruct damaged,and dispose rights incom-plete.The farmers land rights are infringed in varying degrees by all levels of administration,and also the optimal allocation of land resources restricted.Constitute and exert the rural land property rights system in legal which clears the object and consummates other rights,and promote the innovation of land property system,in order that the farmers could hold the exclusivities,in law,of property rights,use rights,usufruct and the independence of right to transfer.Furthermore,it could also promote the effectiveness of property rights,and realize the optimal allocation of resources.
