摘    要:随着2008年《劳动合同法》及其《实施条例》的实施,商业银行分支机构开始对编外用工人员实施劳务派遣。这种新型用工方式在减少用工风险、降低用工成本等方面成效明显,但在适用范围、派遣公司选择、雇主责任承担方面存在的法律风险也不容忽视。

Abstract:With Labor Contract Law and its Implementing Regulations being implemented in 2008,branches of commercial banks began to implement labor dispatch for their supernumerary labor officers.This new way of labor has obvious effects in reducing labor risk and costs etc.However Legal risk can not be ignored in scope of application,selecting company and employer's liability.
