| 摘 要： | 本文首先对民事主体资格的概念、历史沿革进行了详细的阐述,并在此基础上提出了确立民事主体资格的形式标准和实质标准及构成这些标准的条件.其次以民事主体资格形式标准和实质标准对非法人团体的民事主体资格加以评判,得出非法人团体可以享有民事主体资格的结论.

| Abstract: | On the foundation of explaining the concept of qualifications of civil subject, the article brings up the formal and substantive criteria to establish the qualifications of civil subject and the conditions to constitute these criteria. Then the article adjudicates the qualifications of civil subject of unincorporated association with the above two criteria and comes to the conclusion that unincorporated association possesses qualifications of civil subject. |
