| 摘 要： | 在知识经济的时代,技术创新能力已成为衡量一国经济发展水平和国际竞争力的重要标志。而技术创新只有通过相关法律程序获得合法产权,形成知识产权并得到保护,整个社会的技术创新机制才能健康运行。本文首先阐述了技术创新和专利保护的理论基础,分析了对技术进行专利保护的重要性,主要分析了技术创新和专利保护的相互关系,概括了其积极作用与消极影响,研究了部分高校与企业在对技术创新进行专利保护上出现的问题,分析了应对技术创新选择合理的产权保护方式,最终实现企业的最大利益。
