| 摘 要： | 电子商务实践中存在着主体混同行为、商誉侵权、侵犯商业秘密、域名抢注以及垄断等不正当竞争行为 ,束缚了电子商务的发展。对此应当从现有立法规制和今后立法约束两个方面寻求对策。

| Abstract: | It needs fair competition, instead of unfair competition, between market subjects to develop normally the electronic business. Such unfair competitions in the electronic business practice as confusion of subject, goodwill infringement, trade secret infringement, preemptive registration of domain name and the monopolization in electronic business, has been preventing the electronic business cause from developing rapidly. We may seek countermeasures against the unfair competitions in the electronic business practice from two points, legal restriction and legislation. |
