| 摘 要： | 合同的效力问题是整个合同法的核心问题,它涉及到合同的成立、合同是否有效等概念,本文从合同效力及其相关的合同成立、合同生效等概念进行比较分析,探讨三者之间的联系与区别,提高合同效力判断的准确性,减少合同概念不清而引发的法律纠纷。

| Abstract: | Validity is the core of a contract.It involves concepts like contract formation and contract effect.This thesis analyzes the concept of contract validity and discriminates it with relevant concepts like contract formation and contract effect.We study their connections and differences in order to improve the accuracy of contract evaluation and reduce the legal disputes caused by concept ambiguities in the contracts. |
