| 摘 要： | 在商业银行个人理财业务发展的数年中,投资者权益受侵犯的事例常见于报端。这些问题的出现揭示了目前的认识误区———仅将投资者与银行之间的关系认为是委托与被委托之间的关系。要有效维护理财投资者的合法权益,应重新认识投资者与银行之间的关系。投资者与银行之间不仅是委托与被委托的关系,更主要的是经营者与消费者之间的关系。只有将投资者看成是消费者,在强大的银行经营实体面前,弱势的投资者的合法权益才能得到法律的倾向性保护。
