市场经济下商品流通法制的建立与完善

新中国成立以来,国家对商品流通的管制采取了不同的模式,即计划经济体制下的行政管制模式与市场经济体制下的法制模式,实现了国家对商品流通秩序的维护。我国商品流通相关法律制度,从20世纪80年代以市场经济条件下契约自由为基础的合同法律制度的建立,发展到20世纪90年代《反不正当竞争法》、《产品质量法》、《消费者权益保护法》的应运而生,以及21世纪《反垄断法》的出台。这些法律法规的诞生是市场发展以及商品流通领域发展的迫切需要;是在计划经济向市场经济转轨的过程中发展起来的;是在政府干预程度不断减小的过程中发展起来的。任何一种法律现象或法律问题的产生均与其所处的外部条件相关,且与其所处的背景同构,商品流通法律规制的建立和发展与商品流通产业发展背景同构,是市场经济充分发展的结果,是脱胎于现代市场经济的法制现象,并将随着流通产业的发展而逐步完善、丰富。

The Establishment and Improvement of Regulations of Circulation of Commodities in the Light of Market Economy

Since 1949, our economic system has experienced two periods:planned economy and market-oriented economy.In order to maintain the order of the circulation of commodities, the state has adopted two different models to control the circulation of commodities:the administrative control model of the planned economic system and the legal control model of the market mechanism.Especially under the market-orient economy system, the regulations of the circulation of commodities are aimed at the various market elements of microeconomic level as well as create a series of arrangements on the various relations of trade and competition for markets to correct their behavior and to regulate order.This paper will illustrate the course of the establishment and improvement of the legal system of the circulation of commodities of our country and reveal the synchronized relationship of development between the legal system and industry of that circulation.The result comes from the legal system of modern market-oriented economy and full development of market-oriented economy.
