| 摘 要： | 对知识产权侵权损害赔偿与其他财产侵权赔偿进行差异分析,提出法务会计在知识产权侵害损失估计上的特殊作用,认为知识产权侵害诉讼中法官由于专业知识所限,经常难以对知识产权侵权赔偿数额作出合理确定。法务会计的工作鉴定能有助于法官办案,维护权利人利益。

| Abstract: | This paper calirifies the special function of legal accounting by analyzing the differences of intellectual property compensation and common property compensation.Thanks to the limited expertise knowledge of judges, it is hard for them to fairly decide the amount of compensation in the lawsuits on intellectual property violation.Legal accounting may help to measure the loss of compensation so that the judges fed eaiser to arbitrate and the interest of the relevant parties can be better protected. |
