《旅行社投保旅行社责任保险规定》的弊端及完善

通过分析《旅行社投保旅行社责任保险规定》施行近5年来出现的保险范围不合理,保险金额低,保险费率混乱,责任难认定,理赔程序有弊端及未规定说明义务等问题,提出了统一制订保险范围条款,提高保险金额,规范保险费率,设立仲裁委员会,改革理赔程序及引入说明义务条款等措施,试图为完善旅行社责任保险法规提供借鉴。

The Regulation of the Travel Agency Insures Travel Service Liability Insurance has being executed,following some problems in the past 5 years: the unreasonability of insurance coverage,the low insured amount,the chaos in insurance premium rate,the difficulty for responsibility asserting,the defects of claims settlement procedure and the lack of explained duty.According to the problems above,this article attempts to provide the measures for consummation of the laws and regulations about travel service liability insurance,by making the clause of insurance coverage in unison,raise the insured amount,standardize insurance premium rate,set up arbitration commission,reform the claims settlement procedure and introduce the clause of explanation obligation,etc.
