浅议公共治理中的软法

软法是伴随着硬法立法滞后、协商民主思维兴起而发展起来。它在公共治理中起着增强公民的主体意识与促进社会自治、填补硬法的不足,降低立法与执法成本、防止公权力滥用的积极作用。但软法还有可能产生对法治期待误读、影响法的安定性、异化为侵犯公民权利的工具等方面的消极影响。因此有必要把软法的制定主体、制定权限、制定程序和实施监督纳入到法治的轨道,通过法治原则来规范软法的发展。

Discussion on Soft Law in Public Governance

Soft law appeares with the legislation lag of hard law,development of deliberative democracy.It plays an active role in public governance,which helps to raise citizens＇ subjectivity,promote society autonomy,remedy the defect of hard law,reduce the cost of legislation and law enforcement,and prevent the abuse of public power.But soft law covers some positive roles as misunderstanding of ruling by law,being a tool for infringing civil right,etc..Therefore soft law is enacted by means of rule-by-law principle.
