内幕交易罪的司法困境及出路研究

In recent years, insider trading cases become more frequent, whether the ＂Hangxiao Steel Structure case＂ or the ＂Shanghai Zulong insider trading case＂, has both aroused great controversy concerning on judicature cognizance in both the theoretical and practical fields. It fully demonstrates that there are many problems about insider trading in the judicial practice, which we should handle in the future. Only by in-depth analysis of these judicial problems, reconstructing the standard of judges insider information, improving the forensics path of insider trading, enhancing the insider trading, enforcement and promoting the mechanism design, can we deal with the judicial problems to protect the justice in the securities market, as well as ensure the securities laws to be complied with and enforced.
