| 摘 要： | 我国关于矿产勘查用地的准入规定较为粗疏,可操作性不强,阻碍了矿产勘查人利益的实现。本文借鉴矿业发达国家澳大利亚三个州(西澳、昆士兰、新南威尔士)有关矿产勘查用地纠纷解决的相关制度,为实现矿产勘查用地受偿权利,可分三步走:一是协商;二是行政部门主动调解;三是法院裁决。

| Abstract: | The regulations of the land access for min eral exploration in China are so inattentive that hindered the realization of the interests of the holder of mineral exploration right. Using the provisions of the land access of mineral exploration and disputes solution system in Western Australia, Queensland, New South Wales for reference, the article provides the route of realizing the right of the holder of mineral exploration right：1st,negotiation; 2nd,administrative mediation;3rd,adjudication. |
