| 摘 要： | 违约精神损害赔偿制度是侵权法领域中颇有争议的问题。通过对大陆法系中法国、德国和英美法系中英国、美国违约精神损害赔偿制度的比较考察,以及对中国违约精神损害赔偿制度现状的分析,建议中国应制定统一的精神损害赔偿的法律规范,构成要件及鉴定标准应有明确的科学界定,扩大赔偿范围,确定赔偿的数额标准,确立赔偿的一般原则和特殊原则。
