深圳“违法建筑”的产权分析

"违法建筑"是指:城市规划区内未经规划土地主管部门批准,未领取建设工程规划许可证(或临时建设工程规划许可证),擅自建筑的建筑物和构筑物。本文引入产权的分析框架,对"违法建筑"进行了探讨。认为:在当前的政策框架内,"违法建筑"不完全产权的界定过程是建筑人获取公共领域利益的过程,具有经济合理性和社会合法性,具有政府和建筑人双边治理的特征。进而,部分"违法建筑"取得政治的合法性。
