| 摘 要： | 近些年因资源出口限制措施引发的WTO贸易与环境争端开始涌现。中国原材料出口限制措施案是其中典型的代表。该案中各方的争议以及争端解决机构的裁决体现了WTO贸易与环境争端解决的一些新特征。通过分析该案可以对资源出口限制措施与WTO规则的冲突有很好的认识。该案体现了WTO在维护贸易规则的同时日益关注资源与环境保护。就我国而言,该案凸显了协调国内法律与政策和WTO规则的必要性,也启示我国应合理进行资源出口限制,在国际贸易谈判中维护自身利益。
