涉外婚姻家庭关系法律适用若干争议评析

2011年4月开始施行的《中华人民共和国涉外民事关系法律适用法》就涉外婚姻家庭关系的法律适用规则的立法有了长足的进步,但其间若干自草案公布之初就存在争议而在正式立法中未得到呼应的些许问题、存疑、争鸣无疑还将继续,如选择性冲突规则运用是否妥当、涉外协议离婚法律适用规定有无必要、＂没有共同国籍＂情形下法律适用是否遗漏,等等。着眼于婚姻家庭关系的内在逻辑、国际社会最新立法经验和中国涉外婚姻家庭法律适用实践,应就以上问题做进一步完善和修订。

Discussion on Some Controversies about Legislation Applicableto Foreign Marriage Relationships

Law of the Application of Law for Foreign-related Civil Relations of the People＇s Republic of China which was put into effect on April,2011 has mad a marked progress on the applicable to foreign marriage relationships.Whereas there still have some disputes about this part which haven＇t been settled and the controversies will go on in the future,such as whether the adopting of selective applicable rules is proper,etc.The above controversies are discussed here in light of the internal logic requirements of marriage and family relationship.The experience of foreign countries and the applicable practice of China in the this area should be born in mind.
