中国-东盟自由贸易区背景下我国网络金融法的完善

《中国—东盟自由贸易区服务贸易协议》的签署对我国金融业、网络金融业既是挑战,也是机遇。我国网络金融方面的法规存在较多问题,包括电子签名、电子支付、电子货币的发行与监管以及与国际接轨等,对此我国应完善电子银行管理办法,修改电子签名法及其相关法规,完善小额电子支付系统的法规,制定大额电子支付系统的法规,建立有关电子信用证的法规,以新的票据法规范可流通的电子票据。在此过程中,还必须加强与东盟国家的合作,充分借鉴国际先进经验,最终促进我国网络金融业的发展。

The Improvement of China''''s Online Finance Law under CAFTA

The Author believes that Agreement on Trade in Service of the Framework Agreement on Comprehensive Economic Co-Operation between the People's Republic of China and the Association of Southeast Asian Nations will bring China's Finance Industry and Online Finance Industry with challenges and opportunities.There are some problems with China's online finance law and regulation,such as the problems of electronic signature,electronic payment,e-currency issue and supervision.So,we should adopt such countermeasures as improving e-banking management,modifying the law and regulation of e-signature,and formulating regulations concerned with electronic letter of credit.Meanwhile,we should strengthen cooperation with ASEAN member countries,draw on the experiences of other countries to promote the development of China's online finance industry.
