我国旅游法的缺位是旅游立法体系基础性的缺陷，是旅游业健康快速发展的主要障碍。构建具有中国特色的旅游立法体系框架，提升旅游行政执法部门的地位，在旅游法的制定中坚持实用与创新原则，逐步构建、完善、充实我国旅游立法体系，是当前我国旅游业发展新阶段所面临的重要课题。

Some Discussions on the Construction and Improvement of China's Tourist Legislative System

By starting the researches from the construction and implementation of China's tourist legislative system,the paper indicates that the absence of China's tourist law is not only the fundamental flaw of the tourist legislative system,but also the obstacle of China's tourist rapid development.Building the tourist legislative system and framework with Chinese characteristics,upgrading the status of the tourist administrative and executive departments,sticking to practical and innovative principles on tourist law legislation,constructing and enriching the tourist legislative system are all the most important tasks that we face and should be achieved in the new period of our country's tourist development.
