| 摘 要： | 我国《公司法》对公司交叉持股没有明确的规定。现实中,金融控股公司与附属金融机构之间存在复杂的交叉持股关系,利弊皆有。本文对金融控股公司中母子公司之间、子公司之间和非母子公司之间交叉持股进行分析,并提出相应的立法规制建议。

| Abstract: | In China,cross-shareholding is ignored and not legitimated in the Company Law.As a mechanism which has two sides,cross-shareholding of financial holding companies and subsidiaries can impose some positive influence while it can also be abused.The article discusses the advantages and disadvantages of three types of crossshareholdings,and puts forward the corresponding legislative proposal. |
