| 摘 要： | 法律实效包括法律效果与社会效果,当今司法越来越重视法律的社会效果,且强调二者的统一,＂6.30＂案就是一个很好的说明。重视法律的社会效果有充分的理论依据与现实依据,但是过分强调也有不合理性。正确的态度是将法律效果作为司法的首要目的,追求社会效果时应当保持克制、理性,法律效果与社会效果无法完全统一,只能趋近。

| Abstract: | The effects of law including legal effects and social effects.Social effects plays an import role in today＇s justice,and we gradually emphasize the unity of the two.We can find this trend easily through the case of zhang mingbao.There is not only theoretical significance but also objective necessity of existence in this emphasis,but too much emphasis is also irrational.The correct attitude is the legal effects and the primary purpose of justice.The pursuit of social effects should be restrained,rational,legal effects and social effects can not be completely united,but approaching. |
