辨析缺陷责任期与保修期

质量保修是各国为确保工程质量所普遍采用的一种有效制度，《中华人民共和国建筑法》、《建设工程质量管理条例》确立了我国现行建设工程质量保修制度。为了完善工程质量保修制度并与国际接轨，国家建设部、财政部发布了《建设工程质量保证金管理暂行办法》，提出了建设工程的缺陷责任期。分析了建设工程保修期与缺陷责任期的区别，并对完善我国建设工程质量保修制度提出若干改进建议。

Quality maintenance is an effective system to guarantee the engineering quality. Building Code, Construction Engineering Quality Management Regulation has established the quality maintenance system of construction engineering in our country. In 2005, In order to improve the quality maintenance system of construction engineering and with the international practice, our country has promulgated Construction Engineering Quality Earnest Money Management Tentative Method, and proposed the defects responsibility period in construction engineering. Through distinguishing between the defects responsibility period and the term of maintenance, some suggestions on improving the quality maintenance system of construction engineering are proposed.
