基本人权基础上的科学化--略论影响证据法发展的几个因素

美国诉讼法学家达马斯卡认为，科学因素是主导证据法未来的决定性因素，笔者对此存有异议。证据法的发展除了受科学进步影响外，也受到或应受到人权等其他因素影响，易言之，证据法的发展过程实质上是在历史传统影响下兼顾基本人权的科学化过程。

The Scientific Factor on the Basis of Fundamental Human Rights: On Several Factors Influencing Evidence Law

Mirjan R. Damaska, an American expert on science of procedural law predicts that the science is decisive factor to the development of evidence law in the future. The author provides a different perspective that the development of evidence law is not only determined by scientific factor, but also affected by the factor of fundamental human rights, in another words, the process of development of evidence law is determined by the scientific factor on the basis of fundamental human rights.
