| 摘 要： | 本文立足于我国目前医疗损害赔偿问题现状,针对司法理论界存在的适用法律不统一,司法实践标准出入较大等现实问题,对我国目前的医疗损害赔偿做概括性的介绍,阐明作者从法理角度,认为按人身侵权进行诉讼优于按医疗事故处理的论点。
