加强农村集体建设用地规划管理初探——以北京地区为例

随着<城乡规划法>的出台,实施城乡统筹的规划管理得到了空前的重视,但由于城乡二元体制等体制性障碍仍旧存在,加强农村地区规划管理在实施层面还存在众多的困难.本文分析了北京地区农村集体建设用地建设的现状,指出农村集体建设用地建设出现诸多问题,其根本原因是体制性矛盾造成的,除了城乡二元的土地制度构成了最大的制度性约束外,还存在各层级责、权、利结构性失衡和规划挤占农村发展空间等制度性问题.同时,加强农村规划管理还面临土地确权不确定因素多、历史遗留包袱重和行政成本高等具体实施困难.最终提出,应按照与体制性矛盾的解决进程相适应和与社会经济发展水平相适应的原则稳步推进农村规划管理,并提出全面推进土地确权、加强村庄规划指导以及开展项目管理试点等具体实施建议.
