| 摘 要： | 人身意外伤害保险是一类重要的人身保险,其针对的保险事故是意外伤害,包括意外和伤害两个层次。保险事故是否为意外伤害也就是决定是否赔付的标准。药物过敏导致的被保险人死亡的事件时有发生,审判实践中一般将药物过敏作为意外伤害对待。甄别药物过敏的性质对于处理人身意外伤害保险纠纷有着重要的意义,在处理该类型的保险合同时,应当限制疑义利益解释原则和保险人说明义务的适用。
