| 摘 要： | 宪法能否在法院如同其他法律一样得到适用,一直以来成为法学界不断争论的焦点。从中国现实出发,在宪法适用的问题上应该遵循一个标准：原则上不适用宪法,特定情况下应该适用。此处的特定情况是指只有在出现宪法案例,且符合宪法判断回避原则的时候,应该适用宪法,即宪法的保守适用。

| Abstract: | Whether or not the Constitution should be applied generally as other law has been a controversial point in the field of law.From the perspective of the reality in China,we should follow a standard about application of Constitution.That is to say,the prohibition use of Constitution in principle could be use in particular case.This particular case refers to constitutional case.And what’s more,this case should accord with the principle of avoiding using Constitution.That is the conservative application of the Constitution. |
