| 摘 要： | 毛泽东的法律观秉承＂古为今用＂,继承和发展了儒家的人本主义传统,对近代中国革命和法文明的发展起到了推动作用,但同时,对传统人本思想的过分夸大也阻碍了建国初期的法治文明进程。对毛泽东法律观与儒家人本主义之间的联系进行剖析,进而对当今法治社会下继承人本主义传统的时代价值进行探讨。
