我国实施《劳动合同法》的博弈分析

摘    要:在理性经济人假设下,建立劳动监察部门、劳工和企业的三方博弈模型,通过求解纳什均衡,结合各参数变量的政策含义,认为政府要进一步完善相关法律制度,加大赔偿额;各级政府要进一步加大劳动保障监察队伍的建设;劳动监察部门要进一步加强对用人单位劳动用工的指导和管理.严格依法办事,要加大处罚力度;劳动监察部门要不断积累监管经验,要采用先进的技术手段,以期降低监察成本;劳工应主动深入学习《劳动合同法》有关知识,加强法律维权意识。

Game Analysis under China's Implementation of Labor Contract Law
Abstract:Under assumption of economic man, a three-way game model among labor inspection service, labor and enterprise should be established. Through Nash equilibrium, combining with the policy implications of each parameter variables, it is suggested that Government should further improve relevant legal system, increase compensation; Governments at all levels should further increase team building of labor security supervision; Labor supervision departments should further strengthen guidance and management of labor and increase punishment; Labor supervision departments should continue to accumulate experience, use advanced technology to reduce cost; Labor should take initiative to study knowledge related to Labor Contract Law to enhance awareness of legal rights.
