外资非正常撤离法律对策的探讨

Discussion on the Legal Countermeasures of Abnormal Evacuation of Foreign Investment

The abnormal evacuation of foreign-owned enterprises has taken place frequently in China,which brings not only serious economic damages to the related interests′parties,but also certain negative impacts on China′s investment environment and social stability. To a large extent,the breaking of international financial crisis evokes the evacuation of foreign investment. Local government departments′excessive pursuit economic and fiscal fruits are the basic reasons of abnormal evacuation of foreign investment. Based on the objective understanding of the causes,it is necessary to study the legal countermeasures to cope with the foreign capital abnormal evacuation. The remedial mechanism,including supervision liquidation mechanism,emergency linkage mechanism and legal action mechanism,should be taken. These legal measures can reduce the negative effects of foreign investment abnormal evacuation and perfect Chinese foreign investment system.
