论国际商事惯例

国际商事惯例具有法源的性质,有别于国际商事交易习惯。国际商事惯例具有反复实践、得到普遍遵守具有法律确信的特点。国际商事惯例的表现形式包括成文和不成文的惯例。在法的层级效力上,国际商事惯例次于我国加入或者缔结的国际条约与我国的制定法。在不违反我国公共利益的原则下,如果当事人有约定,或者是我国法没有规定且我国缔结与参加的国际条约没有约定的实现,则应当适用国际商事惯例。

On International Commercial Usages

International commercial usages which differ from international commercial practice have the nature of source of law.International commercial usages have the basic characters of repeatedly practice,widely observed and opinion juri.The forms of international commercial usages include written and unwritten usages.As for the level effect of law,international commercial usages are lower than international treaties acceded or concluded by China and the laws of China.Subject to the principal of non-violation of the China's public interests,where the parties agreed or the matters not covered by the laws of China or international treaties acceded or concluded by China,then the international commercial usages shall be applied.
