| 摘 要： | 我国入世后，我国企业境外投资经营的步伐加快，掀起一轮境外投资收购的浪潮。政府对于境外投资如何规范、引导，促进已日益成为突出的问题，中国现行有关对于企业境外投资的审批制度已不适应现实的发展，并且存在诸多法律空白，本文试图在考察我国境外投资审批制度的历史与现状的基础上，借鉴各国的有益经验，对完善我国境外投资审批制度进行法制层面的思考并提出若干建议．

| Abstract: | After the entry to WTO, Chinese enterprises accelerate the pace of oversea investment. How to regulate, guide and promote oversea investment by our government has been a serious problem. Chinese current examination and approval system on oversea investment has not been suitable for the ever changing demand, there is large room in law to improve in this field. Based on reviewing the history and analyzing the reality of the oversea investment examination and approval system, this article tries to give some legislative advice on perfecting it. |
