| 摘 要： | 文章针对当前村民自治的现状及存在问题，从立法层面进行分析，提出若干解决思路：一是要进一步从立法上厘清村民自治与基层政权之间的关系，村民自治是一种非政权性质的社区民主；二是要进一步完善选举相关法律法规；三是要科学设定选举操作程序规范；四是要增加对村委会选举违法行为的认定和处理规定。

| Abstract: | Aiming at the present situation and existing problems of villager autonomy,the paper analyses from legislation,and puts forward some solutions:one is to further clarify the relationships between the villagers autonomy and grassroots regime from legislation, the villagers' autonomy is a kind of political nature of community democracy; Two is to further improve election related laws and regulations; Three is to set scientific and normative election procedures; Four is to increase the village committee elections illegal behavior cognizance and treatment. |
