| 摘 要： | 我国合同法规定,当事人订立合同,采取要约、承诺办式,故要约是订立合同的必经阶段,也是合同缔结的启动程序。因此,为使合同成立,要约必须有效。而要约是否有效,其特征和法律效力起着很大程度的作用。本文通过比较分析,就要约的特征及其法律效力作以简单阐述。

| Abstract: | As Contract Law of the People＇s Republic of China demands the parties shall conclude a contract in the form of an offer and an acceptance,and the offer is the start procedure and a stage of concluding a contract.Agree to an offer and therefore enter into a contract.The feature and legal effect have great function of a valid offer.This thesis is about expounding the feature and legal effect of an offer briefly through comparative analysis. |
