新旧国家赔偿法归责原则之比较

在2010年4月29日通过的修改国家赔偿法的决定中,对该法的归责原则进行了调整。原来确定的单一的违法归责原则制度已经转变为违法归责原则和结果归责原则并用的归责体制。结合新法规定的行政赔偿范围与刑事赔偿范围,新法确定的归责原则应该是“违法归责原则”和“结果归责原则”。
