旅游景区对游客的安全保障义务

旅游景区安全保障义务是民事法律为保护游客人身安全而确定的法定义务,该义务来自法律的规定及诚实信用的民法基本原则,具体内容包括提醒、警示、警告、疏导、制止及及时的救助.景区未履行安全保障义务造成游客伤害的,应承担损害赔偿责任.景区不是对一切损害都承担责任,景区可举证证明自己已履行了安全保障义务、游客的故意或过失、第三人已承担了责任、不可抗力等情形予以全部或部分免责.旅游景区侵害行为与旅行社侵害行为直接结合发生损害后果,应承担连带责任;旅游景区侵害行为与旅行社过错行为间接结合发生损害后果,应根据各自过错大小及原因力比例承担相应赔偿责任.
