| 摘 要： | 违约责任与侵权责任是民法中两类重要的民事责任 ,二者在责任的含义、构成及承担方式等方面有着明显区别。正确区分这两种民事责任 ,有利于解决它们的竞合问题 ,妥善处理民事纠纷 ,维护当事人的合法权益。

| Abstract: | Liability for breaking a contract and for tort are the two important civil liabilities in civil law. The two have distinct differences in the connotation, construction and the mode of inheritance etc.. To correctly tell them apart is helpful for dealing with the civil disputes and protecting their legitimate rights and interests. |
