| 摘 要： | 人性是人文社会科学的哲学基础,对法学也不例外。主体权利意识离不开人性的需要,人性需要与法治 理念相统一,人性的需要是公民权利的内在依据。西方流行的“人性恶”理论是特定主体的一种文化观,是主体根据 自身需要构建的人性观念,有很大的主观性。

| Abstract: | Humanity is the philosophic basis of humanity and social science, and the science of law is no exception. Main body's right concept can not be separated from humanity's need. Humanity's need should be unified with the concept of rule by law. Humanity's need is internal basis of citizen's rights. The popular theory in the west that "Humanity is evil" is a cultural value for some certain people, and a humanity concept established according to their own need, therefore it is quite subjective. |
