针对铁路货物运输迟延及法律救济问题,首先对铁路货物运输迟延的概念,铁路货物运输迟延的各种情形及其原因,铁路货物运输迟延的法律性质等问题进行了简要分析;其次,介绍了现行立法关于铁路货物运输迟延救济措施的法律规定,并重点分析了我国现行法律的救济措施及立法缺陷;最后,为完善铁路货运迟延的法律救济,提出了完善铁路货物运输迟延法律救济的立法建议。

Study on Railway Freight Transport Delay and the Legal Remedial Measures

In view of the legal matters concerning railway freight transport delay,the paper first clarifies the concept of delay when transporting goods by rail,its varieties and respective causes as well as its legal nature,then,introduces the current legal provisions on its remedy,placing emphasis on the remedial measures endorsed by the current legal system of China and its legislative defects,and,at the end,proposes suggestions for the improvement of the concerned legal systems.
