| 摘 要： | 在西部开发中 ,BOT模式是一种理想的引进资金进行基础设施建设的方式。但目前存在较多的法律障碍 ,建议先制定一部适应西部大开发的专门BOT行政法规 ,从法律上解决项目公司的融资和政府对BOT项目支持的问题。

| Abstract: | BOT is a suitable method which can build infrastructure through absorbing investment in the development of west China. At present,there are many legal obstacles. This article put emphasis on the discoursing of investment on the item company and the support of BOT that government should give and other legal problems. Then give some advice. |
