市民社会和政治国家的融合和良性互动促使社会法产生,经济法作为社会法中的一个法律部门,具有强烈的社会性。市场自身无法克服的市场失灵现象使政府职能有所扩展。使其运用有形之手干预经济,协调市场主体之间的利益冲突和维护社会整体利益。经济法正是为了规范干预的手段、程度、范围等而产生,显然具有社会性。

On the Social Nature of the Generation of Economic Law

The merging of citizens' social and political state and its favorable interaction promote the generation of social law. Economic law, as a law section in social law, has strong social nature. The uncontrollable phenomenon of market itself broadens government functions, makes it intervene in economy visibly, coordinates the interest conflicts of the main parts in market and remains the whole interests of society.
