论新型商标的法律保护

新型商标作为我国现行商标法新增的保护种类,与传统的平面商标在保护理由和权利内容方面并无二致,但将新型商标作为商标注册的客体,则会出现以往在平面商标保护中不曾有过的法律问题,需要在今后的立法中加以完善。

As the newly adding protection type of the trademark law of our country,there's no difference between the newly-style trademark and traditional plan trademark in the aspect of the reason of the protection and the content of the right.But if we make the newly-style trademark as the object of the trademark registration,then we'll face the legal question that we never met before in the protection of the plan trademark.Some questions should be perfected in the afterwards lawmaking.
