论WTO体系下规章的司法审查

确立和完善对抽象行政行为的司法审查，是我国“入世”后的必然趋势，尤其是对高层级行政机关制定涉及WTO贸易的规章，人民法院应发挥有效的监督作用，这既是维护国家经贸安全之所需，也是我国履行“入世”承诺的需要。对“涉世”规章司法审查的意义、原则及模式进行前瞻性研究，可以引起社会各界对人民法院审查“涉世”规章作用的重视，以适应审判工作国际化的需要。

The Judicial Review of Administrative Regulations under the WTO System

It is the inevitable trend to set and embody the judicial review of abstract administrative actions.Especially reviewing the legitimacy of the regulations about the WTO trade,the people's court should exert more supervising functions.It can benefit the foreign trade security,and fit to the promise of Chinese entry into WTO.The thesis focuses on the significance,the principals and the patterns of judicial review of administrative regulations under the WTO,and the purpose is to arouse the attention to highlight the problem.
