| 摘 要： | 预约合同本质就是一种契约,其目的是将来与特定的相对人订立本约合同。所有类型的合同均可订立预约合同。预约合同的内容决定了预约合同的效力。对于预约合同内容详尽的,其效力以＂必须缔约说＂较为合理。对于条款简单的预约合同,其效力以＂必须磋商说＂较为合理。
